Incumbent faces challenge for judgeship

KINGSTON – Two candidates are vying for a 14-year term as a state Supreme Court justice in New York’s Third Judicial District.

One-term incumbent Republican Anthony Carpinello of Rensselaer County is being challenged by Democrat Patrick McGrath, a Rensselaer County Court judge. The winner of the Nov. 4 contest will preside over state Supreme Court cases in a district that includes Albany, Columbia, Greene, Rensselaer, Schoharie, Sullivan and Ulster counties.

McGrath, 55, has been Rensselaer County judge since 1994. He graduated from Manhattan College in 1975 and Albany Law School in 1978. In 2006, he was appointed acting state Supreme Court judge in the Third District.

His previous experience includes serving two four-year terms on the Troy City Police Court beginning in 1985, serving as assistant Rensselaer County district attorney from 1980-82 and serving as deputy chief clerk and chief clerk of Albany County Surrogate’s Court from 1978-80.

“I bring 23 years of trial experience,” McGrath said. He said there is a real need for trial court judges in the Third District because there are only six covering seven counties.

McGrath said he is not interested in going to the Appellate Division because he enjoys trial court. He also said he was the first judge to establish an upstate drug court, in 1997.

McGrath is running on the Democratic and Working Families lines. He and his wife, Louise, live in Troy with their four children, Patrick, Molly, Alison and Timothy.
